How do you answer EU law questions? ›

Strictly speaking, EU law consists of the founding Treaties (primary legislation) and the legal acts that the European institutions adopt, which enables the EU to exercise its powers (secondary legislation: regulations, directives, decisions, recommendations and opinions).

'Retained EU law' is a concept created by the European Union (Withdrawal) Act 2018. This act took a 'snapshot' of EU law as it applied to the UK at the end of the Brexit transition period on 31 December 2020 and provided for it to continue to apply in domestic law.

Under this principle, EU measures: must be suitable to achieve the desired end; must be necessary to achieve the desired end; and. must not impose a burden on the individual that is excessive in relation to the objective sought to be achieved (proportionality in the narrow sense).
